Consumer: a natural person acting for purposes outside their business, commercial, craft or professional activity (art. 3 Italian Consumer Code). Business/Professional: anyone purchasing in the exercise of their business or professional activity, including companies and entities.

B2B self-declaration: anyone entering a VAT number and/or requesting a business invoice declares that they act as a Business. Consumer protections (right of withdrawal and legal guarantee of conformity) do not apply to such purchases, which are governed by Section 9.

Three regimes apply: Consumers (Sec. 7–8), Businesses (Sec. 9), non-EU customers (Sec. 10).

The following form an integral part of the Terms and apply to purchases: Shipping, Returns and Refunds (incl. withdrawal), Warranty, Payments, Privacy and Cookie Policy. In the event of a conflict on a specific matter, the policy dedicated to that matter prevails.

All orders are charged in Euros; any currency-conversion fees are applied by the customer's bank. Prices vary by detected geolocation: for IPs within the European Union the price is shown VAT-included for the relevant country (e.g. Italy 22%, Germany 19%, France 20%); for all other countries the price is shown excluding VAT/taxes. Please do not use VPNs or tools that inhibit geolocation. On each product page, below the price, the applied VAT rate or the VAT/tax exclusion is always indicated.

Pricing/description errors: in the event of a manifest error, ECS may cancel the order, giving notice and refunding any amount already paid; if the correct price is higher than displayed, ECS may contact you for instructions before shipping. Product availability is not guaranteed.

Submitting an order constitutes a purchase proposal. The contract is concluded upon ECS's shipping confirmation; you will receive confirmation by email.

ECS may refuse an order if it cannot obtain verification from the customer's bank. An order cannot be modified after submission for available items. Separately placed orders ship separately. ECS may postpone shipping for reasons beyond its control; promotions or sales may cause delays. ECS may refuse orders or services to anyone, where permitted by law.

Extra-EU shipments: all orders shipped outside the European Union are DDU (Duties Delivery Unpaid): the end customer is responsible for paying any VAT and duties at their import customs. ECS does not cover VAT, duties or handling charges requested by non-EU importing countries.

Intra-EU shipments: no VAT or duties are due beyond what is paid to ECS. VAT-exempt intra-community purchases: pursuant to art. 41(1) of Italian Decree-Law 331/1993, intra-community supplies of goods are VAT-exempt under the "destination" taxation regime (VAT due in the EU country of destination where the buyer is a VAT-registered taxable person there).

A Consumer has the right to withdraw within 14 days of receiving the goods, without giving reasons and without penalty (arts. 52–59 Italian Consumer Code). Withdrawal is exercised by sending an explicit statement to info@espressocoffeeshop.com; the model withdrawal form (Annex I, Part B, Consumer Code) may be used.

Goods must be returned within 14 days of the notice; unless otherwise stated, return costs are borne by the customer. The refund is made within 14 days of the withdrawal notice, using the same payment method; ECS may withhold the refund until the goods are received or proof of return shipment is provided.

Statutory exceptions apply (art. 59), including made-to-measure/personalised goods and sealed products opened and unsuitable for return for hygiene reasons.

Diminished value. The Consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning (art. 57 Italian Consumer Code). In such cases ECS reserves the right to deduct from the refund an amount corresponding to that diminished value, assessed case by case based on the condition of the returned item (e.g. use beyond mere inspection, signs of use, missing accessories or original packaging). Goods sold to Consumers are covered by the 24-month legal guarantee of conformity from delivery (arts. 128 ff. Italian Consumer Code, as amended by Legislative Decree 170/2021), which is mandatory and non-excludable. In case of a lack of conformity the Consumer is entitled to have conformity restored (repair or replacement) or, where applicable, to a price reduction or contract termination. For non-EU customers, the Warranty policy and applicable law apply. Details and procedure in the Warranty policy.

For purchases made by Businesses (VAT-number holders, companies and entities), the right of withdrawal, the Consumer legal guarantee of conformity and the consumer's forum do not apply. Instead:

• Warranty for defects under arts. 1490 ff. of the Italian Civil Code: defects must be reported within 8 days of discovery (art. 1495 c.c.); the action is time-barred 1 year from delivery;
• ECS's liability is limited, to the extent permitted by law, to repair or replacement of the defective goods, excluding any indirect or consequential damages;
• Invoicing: correct tax details are required; for VAT-exempt intra-EU supplies a valid VAT number registered in VIES is required (art. 41 DL 331/1993);
• Exclusive jurisdiction: the courts of Padua (Italy).

For deliveries outside the European Union, prices are shown excluding VAT and shipping is DDU: VAT, duties and customs charges are borne by the customer at the import customs. EU Consumer protections (withdrawal and the 24-month legal guarantee) do not apply to non-EU deliveries, except as may be provided by applicable local law; any warranties are governed by the Warranty policy. The customer is responsible for compliance with the import rules of their own country.

ECS may suspend or permanently block an account, with immediate effect and without notice, in case of unlawful or fraudulent activity or abnormal use of the Site, including the use of BOTs, scrapers or tools that alter or compromise the Site's functionality and security. Interfering with the Site or using it for unlawful purposes is prohibited.

To the extent permitted by law, ECS is not liable for indirect, incidental or consequential damages. Nothing in these Terms excludes or limits ECS's liability for wilful misconduct, gross negligence, death or personal injury, nor the mandatory rights granted to Consumers. ECS is not liable for failures or delays due to causes beyond its reasonable control (force majeure).

The Site's content (text, graphics, logos, photographs, layout, software) belongs to ECS or its licensors and may not be reproduced without written authorisation. Third-party trademarks and trade names — including Mahlkönig, Eureka, La Marzocco, Rocket, Rancilio, Weber Workshops, PUQ Press — belong to their respective owners; ECS sells them as an authorised reseller and claims no rights over such marks.

The processing of personal data is governed by the Privacy and Cookie Policy, in compliance with Regulation (EU) 2016/679 (GDPR). The use of cookies is subject to your consent (opt-in) via the cookie banner. You agree to receive electronic communications relating to your orders; marketing communications are sent only with prior consent, revocable at any time.

Governing law: Italian law. For Consumers, mandatory protective provisions and the jurisdiction of the consumer's place of residence or domicile remain unaffected. For Businesses, exclusive jurisdiction of the courts of Padua.

Changes: ECS may update the Terms; changes apply to orders placed after publication, with an updated "Last updated" date.

Language of the contract: the Terms are available in Italian, English, Spanish and Japanese; in case of discrepancy, the Italian version prevails.
